Supreme Court To Set Up Bench To Hear On Hijab Ban

(The Quiver): Challenging the decision of High Court to lift the ban on hijab, the Supreme court of India has ordered to set up a bench to hear the pleas which determines the ban on hijab in the educational institutions.

After agreeing to hear the petitions challenging the Karnataka High Court verdict on the issue, The CJI says, due to health problems of one judge, I will constitute the bench.

“The matter would have been shut down if the health of the judge would have been good.” he added.

Prior to lawyer Prashant Bhushan, who made an obligation of the difficulty and complexity of the girls who are losing out on academics. Further, the appeals against the decision on March 15th where the high court rejected the requests to wear hijab in classrooms.

The Karnataka government issued the aforementioned order, which Muslim girl students challenged in the high court, banning the wearing of clothing that interferes with equality, integrity, and public order in schools and institutions.

In their argument, the petitioner claimed that a state government order issued under Sections 7 and 133 of the Karnataka Education Act, 1983 had violated their fundamental rights, and they had sought redress in the high court.

In one of the plea, it had mentioned that, the high court “erred in creating a duality between freedom of religion and freedom of conscience wherein the court has concluded that people who follow a religion cannot have the right to conscience.”

The petitioners had additionally argued that ban violated Article 19 dealing with personal liberty and Article 21 which deals with freedom of expression.
